  1. Software License Agreement
  2.  
  3. IMPORTANT: THIS IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN 
  4. INDIVIDUAL OR AN ENTITY) AND INFINITY SOFTWORKS, INC.  BY USING
  5. THIS SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE 
  6. AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.  
  7. YOU FURTHER AGREE THAT IT IS THE FULL AND COMPLETE AGREEMENT 
  8. BETWEEN US, SUPERSEDING ALL PRIOR WRITTEN OR VERBAL AGREEMENTS 
  9. OF ANY KIND.  IF YOU DO NOT UNDERSTAND OR DO NOT AGREE TO THE 
  10. TERMS OF THIS AGREEMENT, YOU MUST CEASE USING THIS PRODUCT 
  11. IMMEDIATELY AND PROMPTLY RETURN ALL MATERIALS (INCLUDING 
  12. DISK(S) AND WRITTEN MATERIALS) TO INFINITY SOFTWORKS, INC.
  13.  
  14. Infinity Softworks, Inc., Software License Agreement
  15. 1.    GRANT OF LICENSE.  This License Agreement permits you to 
  16. use one copy of the enclosed Infinity Softworks, Inc., software
  17. program (the "SOFTWARE") on a single computer.  The SOFTWARE is
  18. in "use" on a computer when it is loaded into temporary memory 
  19. (i.e. RAM) or installed into permanent memory (e.g. hard disk, 
  20. CD-ROM, or other storage device) of that computer.  However, 
  21. installation on a network server for the sole purpose of 
  22. internal distribution shall not constitute "use" for which a 
  23. separate license is required, provided you have a separate 
  24. license for each computer to which the SOFTWARE is distributed.

  26. 2.    COPYRIGHT.  The SOFTWARE is owned by Infinity Softworks, 
  27. Inc., or its suppliers and is protected by United States 
  28. copyright laws and international treaty provisions.  Therefore,
  29. you must treat the SOFTWARE like any other copyrighted material
  30. (e.g. a book or musical recording) except that you may either 
  31. (a) make one copy of the SOFTWARE solely for backup or archival
  32. purposes, or (b) transfer the SOFTWARE to a single hard disk 
  33. provided you keep the original solely for backup or archival 
  34. purposes.  You may not copy the written materials accompanying 
  35. the SOFTWARE.
  36.  
  37. 3.    OTHER RESTRICTIONS.  You may not rent or lease the 
  38. SOFTWARE, but you may transfer the SOFTWARE and accompanying 
  39. written materials on a permanent basis provided you retain no 
  40. copies and the recipient agrees to the terms of this Agreement.
  41. You may not reverse engineer, decompile, or disassemble the 
  42. SOFTWARE.  If the SOFTWARE is an update or has been updated, 
  43. any transfer must include the most recent update and all prior 
  44. versions.

  46. 4.    DUAL MEDIA SOFTWARE.  If the SOFTWARE package contains 
  47. multiple media such as 3.5" disks and CD-ROM disks, then you 
  48. may use only the disks of the media appropriate for your 
  49. single-user computer.  You may not use the disks of the other 
  50. media on another computer or loan, rent, lease, or transfer 
  51. them to another user except as part of the permanent transfer 
  52. (as provided above) of all SOFTWARE and written materials.

  54. Limited Warranty
  55. LIMITED WARRANTY.  This program is provided "as is" without any
  56. warranty of any kind, either expressed or implied, including, 
  57. but not limited to, the implied warranties of merchantability 
  58. and fitness for a particular purpose.  The entire risk as to 
  59. the quality and performance of the SOFTWARE is with you, the 
  60. licensee.  Should the SOFTWARE prove defective, you assume the 
  61. risk and liability for the entire cost of all necessary repair, 
  62. service, or correction.  Some states/jurisdictions do not allow
  63. the exclusion of implied warranties, so the above exclusion may
  64. not apply to you.  This warranty gives you specific legal 
  65. rights, and you may have other rights which vary from 
  66. state/jurisdiction to state/jurisdiction.

  68. Infinity Softworks, Inc., does not warranty the functions 
  69. contained in the SOFTWARE will meet you requirements, or that 
  70. the operation of the SOFTWARE will be error-free or 
  71. uninterrupted.  Infinity Softworks, Inc., does warrant that the
  72. disk(s) on which the program is furnished shall be free from 
  73. defects in materials and workmanship for a period of ten
  74. (10) days from the date of purchase, so long as proof of 
  75. purchase is provided.

  77. CUSTOMER REMEDIES.  Infinity Softworks' and its suppliers' 
  78. entire liability and your exclusive remedy shall be, at 
  79. Infinity Softworks' option, either (a) return of the price 
  80. paid, or (b) repair or replacement of the SOFTWARE that does 
  81. not meet Infinity Softworks' Limited Warranty and which is 
  82. returned to Infinity Softworks with proof of purchase.  This 
  83. Limited Warranty is void if failure of the SOFTWARE has 
  84. resulted from accident, abuse, or misapplication.  Any 
  85. replacement SOFTWARE will be warranted for the remainder of the 
  86. original warranty period or ten (10) days, whichever is 
  87. longer.  Neither these remedies nor any product support 
  88. services are available outside the United States without proof 
  89. of purchase from an authorized non-U.S. source.
  90.  
  91. NO OTHER WARRANTIES.  To the maximum extent permitted by 
  92. applicable law, Infinity Softworks, Inc., and its suppliers 
  93. disclaim all other warranties, either express or implied, 
  94. including, but not limited to, implied warranties of 
  95. merchantability and fitness for a particular purpose, with 
  96. regard to the SOFTWARE, the accompanying written materials, and
  97. any accompanying hardware.  This limited warranty gives you 
  98. specific legal rights.  You may have others which vary from 
  99. state/jurisdiction to state/jurisdiction.
  100.  
  101. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent 
  102. permitted by applicable law, in no event shall Infinity 
  103. Softworks, Inc. or its suppliers be liable for any damages 
  104. whatsoever (including, without limitation, damages for loss of 
  105. business profits, business interruption, loss of business 
  106. information, or any other pecuniary loss) arising out of the 
  107. use or inability to use this Infinity Softworks, Inc., product, 
  108. even if Infinity Softworks has been advised of the possibility 
  109. of such damages or for any claim by any other party.  Because 
  110. some states/jurisdictions do not allow the exclusion or 
  111. limitation of liability for consequential or incidental 
  112. damages, the above limitation may not apply to you.
  113.  
  114. U.S. Government Restricted Rights
  115. The SOFTWARE and documentation are subject to export controls 
  116. under the United States Export Administration Act, as amended, 
  117. which Act prohibits exports of certain commodities and 
  118. technical data, including software, to specified countries.  In
  119. particular, the SOFTWARE may not be exported to Cuba, Iran, 
  120. Iraq, Libya, North Korea, Sudan, or Syria.  You hereby certify 
  121. that neither the SOFTWARE nor the documentation will be 
  122. transmitted or forwarded outside of your country.

  124. If you acquire this product in the United States, this 
  125. Agreement is governed by the laws of the State of Oregon.
